Loan Ark Intake — Privacy Notice

Plain-English summary
Before you start the application, three things to know:
- We only collect what we need to evaluate your loan eligibility.
- We never sell your information. Ever.
- We delete your data 30 days after you submit, unless you become a Loan Ark client (in which case it transfers to our loan-of-record system, Charlie/Wilqo, which has its own privacy notice).
What information we collect
To process your mortgage loan application, we collect:
- Identifying information — your name, date of birth, Social Security number, current and prior addresses, contact info
- Employment and income — current and prior employers, job titles, start dates, base income, overtime, bonus, commission, and other income sources (Social Security, pension, alimony, rental, etc.)
- Asset information — types and approximate balances of accounts you intend to use for your down payment, closing costs, or reserves
- Property information — for refinance, your current property address; for purchase, the target property address if you have one
- Loan preferences— the type of loan you're applying for and related details
- Demographic information — voluntary, collected only for Home Mortgage Disclosure Act (HMDA) reporting purposes; you can decline
What we do NOT collect: account numbers, bank statement transaction details, credit report or credit score, tax returns, or W-2s.
Why we collect it
The information you provide is used exclusively to:
- Determine your eligibility for a mortgage loan
- Match you with appropriate loan products
- Communicate with you about your application and next steps
- Comply with federal and state laws governing mortgage lending (RESPA, ECOA, HMDA, and applicable state regulations)
- Generate the standardized application file (MISMO 3.4 XML) that we transmit to our loan-of-record system, Wilqo's Charlie
Who we share it with
Within Loan Ark: your assigned loan officer, their assistants, and Loan Ark administrators (Jared Price, Don Stolan, Lauren Gurley).
Outside Loan Ark:
- Wilqo, Inc. (Charlie LOS provider) — once your application is submitted and transferred
- Service providers that help us operate this application (Supabase for encrypted database hosting, a private AWS S3 bucket encrypted at rest with AES-256 for secure document storage, accessed only by authorized staff systems, Resend for email delivery) under written contracts requiring confidentiality
- Government agencies and regulators as required by law
We do not share your information with affiliates or third parties for marketing purposes. We do not sell your information.
How long we keep it
- In our intake application: 30 days after submission, then permanently deleted via automated daily purge
- In our loan-of-record system (Charlie):per Charlie's retention policies and applicable federal/state record-keeping requirements (typically 3–5 years post-closing or denial)
- If you abandon the application: 30 days from your last activity, then automatically deleted
You can request immediate deletion at any time by contacting your loan officer.
How we protect it
- Encryption in transit: TLS 1.3 between your device and our servers
- Encryption at rest: AES-256, with additional column-level encryption for SSN and DOB
- Access controls: only authorized Loan Ark personnel can access your data, scoped by role
- Audit logging: every data download or export is recorded with timestamp, actor, and action
Your rights
You may, at any time:
- Access a copy of the information we hold about you
- Correct any inaccurate information
- Request immediate deletion before the 30-day automatic purge
- Withdraw your application
- Opt out of any non-required communications

California residents
If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what categories of personal information we collect, the right to deletion, and the right to non-discrimination. A California Privacy Notice page will be published before California residents can use the app.
